Fair or Unfair
The Ombudsperson can investigate and make recommendations in the interests of fairness.
The rules of natural justice (or procedural fairness) determine what is considered fair in an administrative structure. The basic components of natural justice are:
- The right to know the case against you;
- The right to an impartial and unbiased decision maker;
- The opportunity to be heard;
- The right to a decision and the rationale for that decision.
The (PDF file) Ombudsperson's 2005/2006 Annual Report has an article on making decisions fairly using the principles of Natural Justice.
The (PDF file) Administrative Fairness Checklist and the (image file) Fairness Triangle are helpful tools for decision makers and students.
Please note that while the Ombudsperson may comment on or make recommendations for change in policy, practice or procedures, the Ombudsperson cannot make or “overrule” University policy or replace established legislative, judicial or administrative rules or procedures.
