Contest rules

Toronto Metropolitan University (“TMU”), through its Sustainability Office and Student Life and Learning Support Office (the “Contest Sponsors”), is holding an amazing sustainability race (the “Contest”) to lead TMU students through a series of challenges across campus.

The entry period for the Contest begins on July 2, 2024 at 8:00 a.m. Eastern Time and ends on August 27, 2024 at 10:30 a.m. Eastern Time (the “Contest Entry Period”). To be eligible, the registration portion of the Contest Entry (as defined herein) must be submitted during the Contest Entry Period in accordance with the instructions provided at Section 3 below.

The Contest is open to any group of two (2) to four (4) individuals that each meet the following criteria (hereinafter referred to as “Entrant Team” and each individual, an “Entrant”):

  1. is a resident of Canada (except Quebec); and
  2. is enrolled as a TMU student (full or part-time) during the Contest Entry Period.

A group is not eligible to enter the Contest or be selected as a Winner (as defined herein) if any member of the group is:

  1. an employee, officer, director, representative or agent of the Contest Sponsors, or any other company or individual engaged in the provision of goods or services related to this Contest; or
  2. a member of the immediate family (parent, child, sibling, or spouse) or household (whether related or not), of any of the above individuals set out in (a) of this paragraph.

No purchase necessary. An eligible Entrant Team may enter the Contest by completing the following steps (a “Contest Entry”):

  1. register for the Contest during the Contest Entry Period through one of the following methods:
    1. online between July 2, 2024 at 8:00 a.m. Eastern Time and August 23, 2024 at 11:59 p.m. Eastern Time using the Road to TMU O-Week registration page (https://roadtotmu2024.attendease.com/ (external link) );

The Contest Sponsors, or their designated representative(s), will announce the potential winners at TMU’s Student Learning Centre on the 6th floor (located at 341 Yonge Street, Toronto Ontario) during the Winner Selection Period.

The Contest Sponsors, or their designated representative(s), will make a maximum of two (2) attempts to contact the selected Entrant Teams by telephone or email (using the information provided in the Contest Entry) within five (5) business days of the Winner Selection Period. The odds of winning a Prize depends on the number of Contest Entries received, the number of Challenges completed by Entrant Teams, and the overall Scores of Entrant Teams in each Challenge.

Before the selected Entrant Teams are declared winners (after declaration, each referred to as a “Winner”), each Entrant within the selected Entrant Teams must sign and return, within five (5) business days of notification, a declaration of compliance and release of liability prepared by the Contest Sponsors (the “Release”).

In the Release, each Entrant from the selected Entrant Teams (or, if an Entrant is under the age of 18, the parent or legal guardian of the Entrant) is required to, among other things:

  2. confirm compliance with these Contest Rules;
  3. agree to release the Contest Sponsors, their governors, officers, employees, directors, representatives, and agents, and if applicable, any of their respective advertising or promotion agencies, and any other company or individual engaged in the provision of goods or services related to this Contest (collectively, the “Contest Parties”) from any and all claims, damages, liabilities, costs and expenses arising from any liability in connection with this Contest, the Entrant’s participation therein and/or the awarding and use/misuse of the Prize;
  4. agree to the publication, reproduction and/or other use of Entrant’s name, address (province and city), statements about the Contest and/or photographs, images or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Contest Sponsors in any manner whatsoever, including print, broadcast or the internet; and
  5. acknowledge acceptance of the Prize (if awarded).

A selected Entrant Team is disqualified and forfeits all rights to be the Winner if any Entrant from the selected Entrant Team:

  1. fails to correctly answer the skill-testing question;
  2. fails to return the properly executed Release within the specified time; or
  3. cannot be declared a Winner in accordance with these Contest Rules for any reason;

and the Contest Sponsors reserve the right, in its sole and absolute discretion, to select another Entrant Team as an alternate eligible Winner of a Prize based a random draw (in which case the foregoing provisions of this section shall apply to such new selected Entrant Team).

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, strike or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Contest Sponsors reserve the right to cancel, suspend and/or modify the Contest, or any part of it, and disqualify any individual or entity who is responsible for such action. If terminated, the Contest Sponsors may, in their sole discretion, determine the winners from among all eligible Contest Entries received up to time of such action using the procedures outlined herein.

Use of the Contest Sponsors’ website is at the user's own risk. The Contest Sponsors and Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer or video equipment resulting from participation in the Contest.

By participating in the Contest, Entrants agree: (a) to release the Contest Sponsors and Contest Parties from any and all claims, damages or liabilities arising from or relating to such Entrant's participation in the Contest; (b) under no circumstances will an Entrant be permitted to obtain awards for, and the Entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding legal fees and court costs.

By accepting any Prize, recipient agrees that the Contest Sponsors and Contest Parties will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Contest or from the acceptance, possession, misuse or use of any Prize.  The Contest Sponsors and Contest Parties are not liable in the event that any portion of the Contest is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control.

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE CONTEST SPONSORS’ WEBSITE OR TO INTERFERE WITH THE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND THE CONTEST SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

The Contest Sponsors and their authorized agents will collect, use, and disclose the personal information provided upon registration and entry into the Contest for the purposes of administering the Contest and Prize fulfillment, in accordance with TMU’s privacy policy, available at https://www.torontomu.ca/privacy/.
